Family Law > Children proceedings and public authorities Some of you may be approached by the Local Council/the NSPCC/a so called “authorised person”, because there is some doubt about the way your children are being looked after. This is a very delicate topic, and for those of you facing what are commonly called “Care Proceedings” you need to appreciate the following: 1. “Legal Aid” for Care Proceedings is free for parents and is means tested for other parties. 2. Early legal advice is essential. Many parents assume that the Public Authority involved calls the shots. In fact the ultimate power to decide what happens to your children lies with the Court. 3. Get prompt advice from us when a Public Authority becomes involved because handling the Court procedure in a case like this is a tricky business for the inexperienced. 4. A Court may place a person’s children in the care of, or under the supervision of a Local Authority if it is satisfied the child concerned is likely to suffer significant harm and the harm is attributable to the child being beyond control or the care being given to the child falling below a reasonable standard.
