How the deal came about:
The client had heard of Hopkins, they were using a larger Nottingham firm but were not receiving good service and the costs were mounting as the matter had gone on for 7 years.
What problem did client want us to resolve:
We were tasked with selling some freehold land to a Developer who would then build a doctor's surgery. Our client would then move from their existing surgery to run the new surgery once built.
Our client's main objective was to have a new surgery built, so the issue to avoid was selling the land and then not being granted a lease of the surgery (i.e. if the surgery was not built for whatever reason).
How did we go about resolving problem and outcome:
The legal documents were carefully drafted to take into account all eventualities that might prevent the doctor's surgery being built or the lease not being granted e.g. insolvency of the developer, or transfer of the land to a new developer who then would not grant a lease to our client etc.
Any particular issues highlighted by the case:
The matter highlights the need to consider all potential issues that may arise which would prevent the client's objectives from being achieved. Once the issues have been highlighted then the legal documents need to be amended / negotiated to avoid these issues arising.
